Shipping Terms for Orders Within Ukraine

  1. General Provisions

1.1. Delivery of METALLCAST products within Ukraine is carried out in accordance with the Incoterms 2020 rules as published by the International Chamber of Commerce (ICC).

1.2. Specific delivery terms are agreed upon by the parties in the invoice, specifications, contract, or shipping documents.

1.3. Unless otherwise agreed in writing by the parties, EXW or DDP delivery terms apply depending on the nature of the transaction.

2. Possible delivery terms EXW (Ex Works)

2.1. The Supplier transfers the goods to the Buyer at METALLKAST’s warehouse or production facility.

2.2. The Buyer is responsible for:

  • arranging loading;
  • paying for transportation;
  • bearing the risk of damage or loss of the goods from the moment of transfer.

2.3. The shipping address is specified in the delivery documents. FCA (Free Carrier)

2.4. The Supplier transfers the goods to the carrier designated by the Buyer at the agreed location.

2.5. The Supplier ensures the loading of the goods onto the carrier’s vehicle.

2.6. Risks pass to the Buyer upon transfer of the goods to the carrier. DDP (Delivered Duty Paid)

2.7. The Supplier arranges and pays for the delivery of the goods to the Buyer’s address within Ukraine.

2.8. Risks pass to the Buyer upon transfer of the goods at the destination.

2.9. Unloading of the goods is performed by the Buyer, unless otherwise agreed separately.

3. Delivery Terms

3.1. Production and delivery terms are agreed separately for each order.

3.2. The delivery date may be changed in the event of:

  • force majeure;
  • delayed payment; 
  • changes to technical requirements by the Buyer;
  • delays on the part of the carrier.

4. Acceptance of Goods

4.1. The Buyer is required to verify:

  • quantity;
  • completeness;
  • the external condition of the goods upon receipt.

4.2. Claims regarding damage to the goods during transportation must be recorded in the carrier’s documents at the time of acceptance.

4.3. Signing the delivery documents confirms the Buyer’s acceptance of the goods.

5. Shipping Cost

5.1. Delivery cost:

  • is included in the product price; or
  • is paid separately by the Buyer — depending on the agreed Incoterms.

5.2. For deliveries to remote or frontline regions of Ukraine, the cost and delivery terms are agreed upon separately.

6. Force Majeure

6.1. The parties shall be exempt from liability for failure to perform their obligations in the event of force majeure, including:

  • hostilities;
  • blockage of transportation routes;
  • actions of government authorities;
  • accidents or emergencies.

7. Additional Terms

7.1. Partial deliveries are permitted unless otherwise agreed by the parties.

7.2. Title to the goods passes to the Buyer upon full payment, unless otherwise provided by the contract.

7.3. All disputes shall be resolved through negotiation or in accordance with the applicable laws of Ukraine.
